Welcome to FitFolio (“App”, “Service”), operated by the FitFolio team (“we”, “us”, “our”). These Terms of Use (“Terms”) govern your use of our mobile application. Read them carefully.
By accessing or using the FitFolio app, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use the application.
You must be at least 18 years old to use this App. By using the App, you represent that you have the right, capacity and authority to enter into this agreement and comply with all conditions set forth herein.
Permission is granted to temporarily download one copy of FitFolio for personal, non-commercial transitory use only. This is a license to use, not a transfer of title. Under this license, you may not:
• Modify or copy the materials;
• Use the materials for commercial purposes or public display;
• Attempt to reverse engineer any application software;
• Remove copyright or other proprietary notations;
• Transfer the materials to another person or “mirror” the materials on another server.
This license will automatically terminate if you violate any of these restrictions.
By creating an account, you guarantee that the information you provide is accurate, complete and up-to-date. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account. Please notify us immediately of any unauthorized use or security breach.
The App may allow you to publish, store and share information, text, images, videos or other materials (“User Content”). You are responsible for User Content and grant us the license to use, modify, publicly display and distribute such content on the App as necessary to operate the Service.
You agree not to use the Service to:
• Violate any local, state, national or international law;
• Violate our or third party’s intellectual property rights;
• Harass, abuse, defame or discriminate based on gender, sexual orientation, religion, ethnicity, age or disability;
• Send false or misleading information;
• Transmit viruses or malicious code.
The App and its original content (except User Content), features and functionality are the exclusive property of the FitFolio team and its licensors, protected by copyright laws, trademarks and other regulations in Brazil and abroad.
The App may include features that encourage physical activity. Assess the risks and consult a healthcare professional before beginning any activity. FitFolio is not responsible for injuries or damages resulting from the use of or inability to use the features of the App. The information is for informational purposes only and does not replace professional medical advice.
The materials are provided “as is”. To the maximum extent permitted by applicable law, FitFolio will not be liable for indirect, incidental or consequential damages arising from the use of or inability to use the App.
You agree to defend and indemnify the FitFolio team and its related parties against claims, damages and expenses arising from your use of the App or violation of these Terms.
We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including for breach of these Terms. Provisions that by their nature should remain in force will remain in effect after termination.
We may modify these Terms at any time. If the change is material, we may provide reasonable advance notice. Continued use of the App after changes constitutes acceptance of the new Terms.
These Terms are governed by the laws of Brazil. Disputes may be resolved by arbitration in accordance with the rules of an entity recognized in Brazil, except when small claims court is permitted for qualified claims.
